These Terms govern your access to and use of the ScaleSnap mobile application and related services.
1. Acceptance of Terms
By accessing or using the ScaleSnap application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
2. Description of Service
ScaleSnap is a mobile application that uses computer vision and artificial intelligence to provide estimated weight, measurement, calorie, plant, translation, and object-count analysis features for photos captured via camera or selected from the device gallery. Results are estimates and should not be treated as certified measurements, medical nutrition advice, legal advice, safety-critical information, or professional advice.
3. Accountless Use
3.1.
ScaleSnap does not require you to create an account to use the App. You are responsible for the activity that occurs on your device when using the App.
3.2.
Some App features may depend on device permissions, internet access, App Store purchase status, or subscription status. If those permissions or services are unavailable, parts of the App may not function.
3.3.
If you contact us for support, you agree to provide accurate information needed to help troubleshoot your request.
4. User Content
4.1.
The App may allow you to capture, upload, and store images ("User Content").
4.2.
You retain all rights to your User Content, but grant ScaleSnap a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, and otherwise exploit such User Content for the purpose of operating and improving the App.
4.3.
You represent and warrant that your User Content does not violate the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights.
5. Privacy
Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and disclose information about you.
6. Prohibited Activities
You agree not to:
- Use the App for any illegal purpose or in violation of any laws.
- Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the App.
- Upload invalid data, viruses, worms, or other software agents through the App.
- Use any robot, spider, crawler, scraper, or other automated means to access the App.
- Impersonate another person or misuse another person's device, subscription, or purchase status without permission.
7. Intellectual Property Rights
7.1.
The App and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of ScaleSnap and its licensors.
7.2.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ScaleSnap.
8. Disclaimer of Warranties
8.1.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
8.2.
WHILE WE STRIVE FOR ACCURACY, WE MAKE NO GUARANTEE THAT THE MEASUREMENT AND ANALYSIS FEATURES OF THE APP WILL BE 100% ACCURATE. THE APP IS NOT INTENDED FOR USE IN SITUATIONS WHERE PRECISE MEASUREMENTS ARE CRITICAL.
9. Limitation of Liability
IN NO EVENT SHALL ScaleSnap, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP.
10. Indemnification
You agree to defend, indemnify, and hold harmless ScaleSnap and its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.
11. Modifications to the Service and Terms
11.1.
ScaleSnap reserves the right to modify or discontinue, temporarily or permanently, the App or any features or portions thereof without prior notice.
11.2.
We may revise these Terms from time to time. The most current version will always be on the App. By continuing to access or use the App after revisions become effective, you agree to be bound by the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.
13. Termination
13.1.
We may suspend or block access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.
13.2.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
